  1. Definitions

In these terms and conditions, the following terms shall have the following meanings:

  • “Service” means the cloud backup service provided by the service provider.
  • “User” means the person or entity that uses the service.
  • “Data” means any data or information that the user uploads to the service.
  1. Use of Service

The user agrees to use the service only for lawful purposes and in compliance with all applicable laws, regulations, and policies. The user agrees not to use the service for any illegal, harmful, or unethical purposes, including, but not limited to, hacking, spamming, or sharing copyrighted material.

  1. Data Storage

The service provider will store the user’s data in the cloud and take reasonable steps to ensure its privacy and security. The service provider will use commercially reasonable efforts to maintain the availability of the service, but does not guarantee that the service will be available at all times.

  1. Data Retention

The service provider may delete the user’s data from its servers if the user’s account is inactive for a period of time, as specified in the service provider’s data retention policy.

  1. Payment

The user agrees to pay the fees associated with using the service, including any one-time setup fees or ongoing subscription fees. The user agrees to provide accurate and complete billing information and to update this information as necessary. The service provider reserves the right to suspend or terminate the user’s account if payment is not received on time.

  1. Intellectual Property

The service provider owns all intellectual property rights in the service, including copyrights, trademarks, and patents. The user agrees not to infringe on the service provider’s intellectual property rights, and agrees not to use the service in any way that violates these rights.

  1. Termination

The user may terminate this agreement at any time by providing written notice to the service provider. Upon termination, the service provider will delete the user’s data from its servers, subject to its data retention policy. The service provider may terminate this agreement at any time for any reason, including, but not limited to, the user’s violation of these terms and conditions.

  1. Disclaimer of Liability

The user agrees that the service provider is not responsible for any lost or damaged data, and that the user is solely responsible for backing up their data. The service provider is not liable for any damages, including, but not limited to, lost profits, lost data, or any other incidental or consequential damages arising from the user’s use of the service.

  1. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the service provider is located.

By using the service, the user agrees to these terms and conditions. If the user does not agree to these terms and conditions, they may not use the service.
